I have a message from a friend that I am breaking the Adsense rules by using these images on my website:

http://www.beenidrew.com/wallpapers/html/cartoons/cartoons_001.html

because these images are from Disney and I have no legal rights to use them. Is this correct, please help me to avoid get ban. Thanks in advance.

I think you risk more than that.

Disney could file a DMCA complaint about your site.  If you do not remove their copyrighted content within 48 hours of receiving their notice they can get a court order to get 110mb to close your site & file a lawsuit against you.

Disney have a reputation for being very aggressive when it comes to their copyrighted material.

Oh my goodness but I didn't receive any warning or notice to remove them since 1 and 1/2 year, one more thing that I get these images from other wallpaper website.

That usage will also risk banning from AdSense too. Ads are not allowed to be hidden as part of the content, nor are images allowed to sit next to ads like that. So, the page you showed us is actually a violation of two AdSense guidelines.

PS: None of your sidebar links work. And they're in flash. That needs fixing.

So you are infringing the copyright of the site you took the desktops from & Disney's intellectual property rights.

Can you imagine what a legal person would think of your statement above?

Unless you are getting lots of people downloading them remove the images from your site.  It is not worth the consequences if you get caught.

Are there legal issues - yes
are you violating adsense - yes
breaking laws - yes

odds of getting caught - slim

although you'll probably lose ur adsense

I agree. I doubt Disney would attack you for wallpapers (I mean advertisement much), but the AdSense team will probably catch you pretty quickly.

Unfortunately I read this terms just 3 days ago and I don't know what to do know. maybe I should start over again and again and again and again again again again and again and if it's not enough then I will start over again again again again and again and again.
Well the flash bar links are working fine, maybe you need to hit Ctrl+F5.

Thanks kurse, after this all only you are the person who is giving me some courage just because many of the person who pointed at my website if they look around then they will realize that there are many website who are using the same and doing the same just like: http://www.flash-screen.com/ this is not my website but as you can it too has too many wallpapers on it and especially the formation of ads are just as the same and from Google Adsense, it's not the only one and I don't want to post any other or advertise them for free. All I understand that I am doing my best and believe me there are only few website owners who cares about the privacy policy or terms and conditions and most of them are violating rules and there are thousands who don't even read or understand or follow the rules.

Thanks to you for informing me about the Disney attack and Adsense catch.

It's looks like many of you don't like me to be here at all. You just grounded me.

Don't forget to have a glance at my [ Terms of Usage ] page.

Ask before you PM

Well, in a nutshell. Just because others are doing the wrong thing doesn't mean it is OK for you to do the wrong thing. How would you feel if someone else used stuff you created without your permission?

And, if you are going to use an ad service, it sort of makes sense that you read their terms of service before you start using them, not afterwards; after all, they have the controlling hand when you contravene their terms.

It's looks like many of you don't like me to be here at all.

It's not that we don't want you to be here, it's just we are answering (honestly) the question that you brought forward. I (and I'm sure others) aren't going to lie about breaching TOS's just because it'll make you feel bad.

I agree with robleyd entirely. You should always check the Terms and Conditions before signing up to anything. You agree to use their service, as long as you follow the rules. You do not have the power to go against them, or make exceptions. The rules are the rules, and AdSense won't care 'if you didn't mean to' or 'only read them 3 days ago'. It'll just be bye bye AdSense.

On the Disney lawsuit, let me make my point a bit clearer. I am not saying your wallpapers are okay. I'm just saying that - for such a small site - it is unlikely that will take 'serious' (as in court, and lawsuits) legal action, but that doesn't mean they don't have the right to. You are still breaching copyright, and that is still - regardless of the size of your website - illegal.

You are very right. Next time I am not going to do anything until I read and understand their rules. I just forgot what I was and I am and unfortunately I am doing wrong that if all will jump in the well closing their eyes then I am not one of them. Thanks for your reply.

I understand everyone here are contributing their experience and I believe not one of you said a word wrong for my website, every word from you is correct. Unfortunately I wasn't expecting that much replies about the wrong things I have done and now I understand. Thanks everyone for replying to my post.
